Crisis of the ultima ratio principle. Shall We Resume the Constitutional Criminal Law Guidance?

Contemporary criminal doctrine resorts to the principle of ultima ratio in order to fulfill the main task of minimizing the arbitrariness of criminal law, since through its meaning, the legitimacy of crime and punishment is subject to the condition of the axiological and empirical inexistence of other less drastic legal resources to adequately resolve the conflict generated by its opening.
